These General Conditions regulate the acquisition of products offered on the website www.somoscaprichosas.com, owned by Yoana Cuesta Cortijo (hereinafter, Somos Caprichosas).

The purchase of any of the products implies full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Specific Conditions that may apply when purchasing certain products.

These General Conditions may be modified without prior notice; therefore, it is advisable to read them carefully before purchasing any of the products offered.

All notifications and communications between users and Somos Caprichosas will be considered effective, for all purposes, when made through any of the means detailed above.

Somos Caprichosas reserves the right to decide, at any time, the products and/or services offered to Customers. Therefore, Somos Caprichosas may, at any time, add new products and/or services to those currently offered. Furthermore, Somos Caprichosas reserves the right to withdraw or cease offering any of the products offered at any time and without prior notice.

All of this without prejudice to the fact that the acquisition of any of the products may only be made through subscription or registration of the USER, with Somos Caprichosas granting the interested party a username and password, which will personally identify and enable them to access the products.

Once inside www.somoscaprichosas.com, and to access the purchase of the different products, the User must follow all the instructions indicated in the purchase process, which will imply reading and accepting all the general and specific conditions established on www.somoscaprichosas.com.

  1. AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

Somos Caprichosas aims to guarantee the availability of all products advertised on www.somoscaprichosas.com. However, if any requested product is unavailable or out of stock, the customer will be notified via the email address used for purchase as soon as possible.

If the product is not available, and the consumer has been informed of this, Somos Caprichosas may supply a product with similar characteristics without increasing the price. In this case, the consumer may accept or reject it by exercising their right to withdraw and terminate the contract.

In case of unavailability of all or part of the order, and the customer rejects the replacement products, the previously paid refund will be made by the same payment method used for the purchase.

If Somos Caprichosas unreasonably delays repaying amounts paid, the consumer may claim double the amount owed.

  1. PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase at www.somoscaprichosas.com, the customer must be of legal age.

In addition, the customer must register at www.somoscaprichosas.com using a data collection form, providing Somos Caprichosas with the information necessary for the contract. This information must be true, accurate, and complete, and the customer must expressly consent to this information by accepting Somos Caprichosas' privacy policy.

The steps to follow to make the purchase are:

Product prices may change at any time. In this case, the price applicable will be the one in effect on the date the order is placed. In any case, the final cost will be communicated to the customer during the online purchasing process before formal acceptance.

  1. PAYMENT METHODS

You can make your payment immediately through our bank's secure SSL payment gateway. If any refund or order cancellation is necessary, the amount will be refunded to the same payment card. Orders paid by this method are considered final when our bank notifies us that the transfer has been successfully completed.

Payment for the order will be authorized through PayPal, but no funds will be withdrawn until PayPal verifies that it is correct. A PayPal account is required for this.

  1. RETURN AND WITHDRAWAL POLICY

According to the regulations, consumers and users have the right to withdraw from the contract for a maximum period of 14 calendar days without needing to state a reason and without incurring any costs, except those provided for in Articles 107.2 and 108 of Royal Decree 1/2007, of November 16, which approves the aforementioned text of the General Law for the Defense of Consumers and Users.

This right of withdrawal does not apply, among others, to:

The customer will have a maximum period of 14 calendar days from the day of receipt of the requested goods or products to inform Somos Caprichosas of their desire to withdraw from the contract.

Withdrawal implies that Somos Caprichosas will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the purchased product does not fall within the exceptions indicated above).

During this period, the consumer will communicate to the entrepreneur his decision to withdraw from the contract by filling out the form found at the end of this document and sending it to the Somos Caprichosas email address.

Somos Caprichosas will communicate to the consumer on a durable medium an acknowledgment of receipt of said withdrawal.

To return a product, it must be in perfect condition, in its original packaging, with all accessories, and unused.

Once we receive your request, we will contact you with the details of the return.

The customer will bear the costs of returning the goods.

  1. WARRANTY

Products purchased through www.somoscaprichosas.com have a two-year warranty period from the date of purchase, which covers possible manufacturing defects.

The customer must contact us as soon as possible when they detect the defect, using the usual means of contact.

Excluded from the guarantee are consumables and defects caused by improper use or handling.

  1. LIABILITY AND DISCLAIMER OF LIABILITY

The consumer and user has the right to have the product repaired, replaced, to a price reduction or to terminate the contract, as established in Chapter II Title IV Book II of the General Law for the Defense of Consumers and Users.

If the product does not comply with the contract, the consumer may choose between repair or replacement of the product, both of which will be free of charge for the consumer. The repairs will be carried out within a reasonable period of time depending on the nature of the products and their intended purpose.

If, after the repair is completed and the product is delivered, it still does not conform to the contract, the consumer may demand its replacement, a price reduction, or termination of the contract.

In accordance with the EU Online Dispute Resolution for Consumers and in accordance with Article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform, which is available at the following link: http://ec.europa.eu/consumers/odr/.

  1. APPLICABLE LEGISLATION

These conditions shall be governed by current Spanish legislation.

The language used will be Spanish.
